If this document is being used to notify of involuntary withdrawal, the remaining Partners should create the report and then send a copy of the notice by certified mail to the Partner who is expected to withdraw from the Partnership.

Applicable law

State law governs Partnership. All states allow Partners to withdraw from a Partnership at will - absent any withdrawal restrictions - by providing notice of the Partner's intent to withdraw. Most states refrain from defining adequate notice. Instead, they let the Partnership set withdrawal notification requirements in the Partnership Agreement. However, some states do mandate that the notice be provided in writing or provided a certain number of days in advance of the Partner's final day with the Partnership. Be sure to check for any state requirements that govern this withdrawal letter to ensure compliance with state law.
